Ellen Condon Admnx. to James Clancey & o(the)rs
Know all men by these presents that I, Ellen Condon, administratrix of the estate and effects of Kyran Condon, late of Caplin Bay in the Southern District of Newfoundland, fisherman, deceased; for and in consideration of the sum of eighty dollars payable as follows: Twenty dollars in hand and the balance to be paid on or before the second day of January Anno Domini, One Thousand Eight hundred and eighty five by James Clancey, Thomas Clancey, and Patrick Clancey of Caplin Bay aforesaid, fishermen; have bargained, sold, assigned, transferred, convey, and set over and by these presents do bargain, sell, assign, transfer, convey, and set over unto the said James Clancey, Thomas Clancey, and Patrick Clancey their executors, administrators, and assigns all my right titles and interest as administratrix aforesaid; in and to the eastern half of that piece or parcel of land situate at Caplin Bay aforesaid, the said piece of land being bounded as follows:
On the North by the Main Road leading to Stone Island, on the south by the waters of the Harbor of Caplin Bay, on the east by land in possession of Thomas Condon and on the west by land in possession of John Swain; To have and to hold the said Eastern half of the said before described piece of land with all buildings and erections thereon unto the said James Clancey, Thomas Clancey, Patrick Clancey their executors administrators and assigns forever.
And I the said Ellen Condon, administratrix as aforesaid, hereby covenant with the said James Clancey, Thomas Clancey, and Patrick Clancey including their executors administrators and assigns that notwithstanding any act deed or thing by me done as administratrix aforesaid & now have in myself good right full power lawful and absolute authority to convey and assure the said hereinbefore described property and that the same is wholly unencumbered.
And I the said Ellen Condon, administratrix as aforesaid, hereby further covenant and agree with the said James Clancey, Thomas Clancey, and Patrick Clancey their executors administrators and assigns that I shall and will, when required at the request, costs and charges of the said James Clancey, Thomas Clancey and Patrick Clancey their executors administrators and assigns make do and execute all such further deeds conveyances and assurances as may be lawfully and reasonably required for the more effectively conveying and assuring the said hereinbefore described land and premises.
In witness whereof, I the said Ellen Condon, administratrix as aforesaid, have hereto subscribed my hand and affixed my seal at St. Johns in the Island of Newfoundland this twenty seventh day of November Anno Domini One thousand eight hundred and eighty three Ellen Condon (L.S.)* Signed sealed and delivered in presence of, having first been read over and explained, F. E. M. Bunting £5. Received from James Clancey, Thomas Clancey, and Patrick Clancey the sum of five pounds being their instalment of within consideration money mentioned to be paid in hand Nov 27th 1883 (illegible/faded) to? Frederick E. M. Bunting of St John's, Barrister at Law, maketh oath and saith that he was present on the (?) seventh day of November A. D. 1883 and did see Ellen Condon, the grantor named in the foregoing deed, duly sign, seal and deliver the same F. E. M. Bunting. Sworn before me at St. John's, Newfoundland, this 7th day of December AD 1883 H. J. Wood, Commissioner. Proved upon the affidavit of Frederick E M Bunting on the 7th day of December AD 1883 at eleven o'clock A.M. before me H. J. Wood Commissioner.
