William Sweetland to Elizabeth Carter

This Indenture made this first day of July Anno Domini eighteen hundred and forty three between William Sweetland of Bonavista Esquire administrator as well of the Estate and Effects which were of Henry Sweetland formerly of Ferryland Merchant as of the Estate and Effects which were of Ann Morry formerly of Ferryland aforesaid the wife of the said Henry Sweetland of the one part and Elizabeth Carter of Exeter in England Widow of the second part Witnesseth that for and in consideration of the sum of two hundred and forty six pounds Sterling now due and owing in a Judgment obtained in the Supreme Court of Newfoundland by Thomas Bennett and Peter Weston Carter the representative of the late Robert Carter husband of the said Elizabeth Carter against the said William Sweetland as administrator of the said Ann Morry and in which said Judgment the said Elizabeth Carter is solely interested, and in consideration of the sum of five Shillings, by the said Elizabeth Carter in hand paid to the said William Sweetland at the time of the Execution of these presents the Receipt whereof is hereby acknowledged, He the said William Sweetland, administrator as first aforesaid Hath granted bargained, sold remised, released, enfeoffed and confirmed and by these presents Doth grant bargain sell remise, release, enfeoff and confirm unto the said Elizabeth Carter her heirs and assigns all that lot piece or parcel of land and premises situate and being on the "Downs" in the Harbour of Ferryland aforesaid and now in the occupation of one John Jillard, as tenant thereof bounded on the North East by the Harbour of Ferryland, on the South West by the Road leading to Ferryland Head and on the North West by the property of the late Judge Carter and on the South East by waste land.

And also all houses buildings ways waters easements profits privileges and appurtenances to the same belonging or in any wise appertaining and the ????? and revisions remainder and remainders rents issues profits thereof, and all the Estate rights title interest claim property and demand whatsoever both at Law and in Equity of him the said William Sweetland both as administrator to the said Henry Sweetland and as administrator to the said Ann Morry in to or out of the said lot piece or parcel of land and premises with the appurtenances as aforesaid any and every part and parcel thereof.

To have and to hold the same to the said Elizabeth Carter her Heirs and assigns for ever and the said William Sweetland for himself his heirs Executors and administrators doth hereby covenant promise and agree and with the said Elizabeth Carter his heirs and assigns in manner following that is to say that the said William Sweetland as administrator aforesaid now is at the time of the sealing and delivery of these presents lawfully rightfully and absolutely seized in his demesne as of fee of and in a good perfect absolute and indefeasible Estate of inheritance in fee simple of and in the premises hereby conveted without any manner of Consideration limitation charge or incumberance whatsoever to defeat alter change charge or in any wise encumber the same.

And also the said William Sweetland now has in himself at the time of such sealing and delivery as aforesaid good right full power and lawful and absolute authority to grant bargain sell release and convey all and singular the premises hereby conveyed with their and every of their appurtenances in manner and form as aforesaid according to the intent and meaning of these presents.

                       Deed deliver the same on the day of the date thereof.
