James Walsh to Richd Reddigan

Know all Men by these presents that I James Walsh of Capelin Bay in the district of Ferryland Planter for and in consideration of the Love and affection which I have for Richard Reddigan the younger and the Consideration hereafter set forth have given and granted and by these presents do freely absolutely and irrevocably, Give grant and assign unto the said Richard Reddigan the younger his Executors Administrators and assigns all that Messuage or Tenement Farm Plantation and Fishing Room situate and lying on the NE side of Capelin Bay bounded on the Front by the Water of the Harbour on the SE by a River on the NW by Richard Reddigans Land and waste Land & upon the NE by the woods together with all the buildings Dwelling Houses and erections therein together with nine head of Horned Cattle & one Mare together with all Farm Utensils & all and singular of the Rights, Members and appurtenances to the same belonging or in any were appurtaining.

And also and every the goods and Chattels Household and other Furniture and effects in & upon said Messuage or Tenement Farm Plantation and Fishing Room & Dwelling House hereinbefore described for which said last mentioned Goods Chattels and effects Household & other Furniture possession is intended to be delivered to the said Richard Reddigan the younger at or immediately after the Execution of these presents. And all my Estate right Title Interest Possession property claim and demand whatsoever both in Law & in Equity of in or to the same Messuage or Tenement Farm Plantation or Fishing Room Dwelling House and Household Furniture respectively.

To have and to hold and take and enjoy the said Household and other Furniture Goods Chattels and Effects Farm Plantation and Fishing Room unto and by the said Richard Reddigan the younger His Executors Administrators and assigns absolutely to and for his and their own proper use and Benefit forever. And the Indenture further witnesseth that the said Richard Reddigan the younger in consideration of the premises aforesaid doth hereby for himself his heirs Executors & Administrators Covenant promise Grant & agree to and with the said James Walsh his Executors Administrators and assigns that he the said Richard Reddigan the younger His natural Guardian Heirs Executors, or administrators shall and Will and truly provide or cause to be provided for the said James Walsh & his present Wife Ellen Walsh good and Sufficient necessary Clothing Food and Lodgings for and during the Term of their natural Lives.

And upon the consideration the love and affection aforesaid That the said Messuages and Tenement Farm Plantation Fishing Room & Dwelling House Goods Chattels Effects Furniture and live stock are now given and granted unto the said Richard Reddigan the younger. And I the said James Walsh for my self my Heirs Executors & Administrators shall and will warrant and defend unto the said Richard Reddigan the younger his Executors Administrators & assigns against all persons whomsoever.

           In witness whereof I have hereunto set my hand and seal in Ferryland in the Island of Newfoundland this twentieth day of April and in the year of our Lord one thousand eight hundred and forty four.

2/ The term messuage is an old term used in a deed to signify a dwelling-house and the surrounding property, including outbuildings.
