James Welsh to James Stuart

            Know all men by these presents that I James Welsh Senior of Capelin Bay in the Island of Newfoundland Planter for and in consideration of the sum of sixty pounds current money of this Island to me in hand well and truly paid by James Stuart carrying on business at Saint Johns in the Island aforesaid as merchant under the firm of Rennie Stuart & C. the receipt whereof I do hereby acknowledge and to be therewith fully satisfied have granted bargained sold assign and made over and by these presents do grant bargain sell assign and make over unto the said James Stuart his Executors Administrators and assigns: all that Fishing Room Plantation as now occupied by me on the North Side of Capelin Bay.

           To have and to hold the said room and Plantation with the rights privileges thereof belonging or any wise appertaining unto the said James Stuart his Executors Administrators and assigns forever subject nevertheless to the conditions following: the sum of sixteen pounds currency lawful money of this island shall well and truly be paid by me my Executors Administrators and assigns on the twentieth day of September in the year of one thousand eight hundred and thirty four and a further sum of six pounds in like manner on the twentieth of September in each and every succeeding year until the sum of sixty pounds is fully paid then and in that case this bargain and sale to be null and void but in default of any of the said yearly payments being made at the times herein before mentioned to be paid then and in that case it shall and may be lawful for the said James Stuart his executors and assigns to make this bargain and sale absolute.

           In witness whereof the said James Welsh Sr have to these presents subscribed my name and affixed my seal at Ferryland in the Island of Newfoundland this eighteenth day of December one thousand eight hundred and thirty three.

I certify that the foregoing bill of sale or mortgage was duly acknowledged by James Welsh Senior the party thereto on the twelfth day of March one thousand eight hundred and thirty four and Registered by me on the twentieth day of the same month.
