- Births, Deaths, Marriages in Newfoundland Newspapers (1810-1890) - Death Toole, John, died on the 5th, aged 44, at Caplin Bay. Left wife and 10 children (Jan.25, 1882). [GCC Box 1]
On May 21, 1883, a letter was written by the magistrate at Ferryland, David W. O'Mara, to the Attorney General in St. John's. He was asking advice on how he should handle a bizarre incident that had occured a week earlier on Monday, May 14th. Apparently, during that night a woman named "Clancy entered the cemetery and dug up and cleaned away the earth out of the grave" . This was the grave of a man named Toole who had been buried there about 15 months earlier. Magistrate O'Mara determined that Mrs. Clancy claimed that the burial plot rightfully belonged to her family, but the deceased's family had buried Mr. Toole there anyway. Although she succeeded in digging up the earth around the coffin, O'Mara stated that "the coffin though slightly injured was not removed". The letter goes on to state that "the brother of the deceased has complained before me of the outrage". Magistrate O'Mara went on to ask the Attorney General several questions regarding the charges that could or should be laid, and who should lay them, the clergy or the deceased's family, etc.
This story has been related ever since then with different names given for the individuals involved and with certain local embellishments to the details of the incident. Sometimes the man's name is given as Terrance or Martin O'Toole. However, the timeframe fits very well with the documented death and burial of John (O') Toole. Terrance was his father, but his date of death is not known. The only Martin (O') Toole that I am aware of is John's son, and he died in 1915. The woman involved has been mentioned as Marie Clancy, although none of the records that I searched mention anyone of that name. In other local stories her name is given as Bridget Clancy. This is possible since there was two Bridget Clancys at Caplin Bay at that time.
